HOW TO ENTER THIS CONTEST:
The contest begins at 4:00PM Central Time (“CST”) on September 15, 2015 and ends at 10:00 CST on September 30, 2015 (“Entry Period”).
You can enter this contest by logging into your Instagram® account and following these instructions
- upload a photo
- tag @thepreppytexan in the caption of the photo
- hashtag#txyourprep hashtag in the caption of the photo—–These 3 items must be done all in compliance with the terms and conditions of these Official Rules.
In order for your photo to qualify you to enter this Contest, the photo and the circumstances surrounding your uploading the photo must satisfy the following conditions: (a) the “Photos Are Private” option in your Instagram® account must be set to “OFF”; (b) you must be following @ThePreppyTexan, @ArnoldSteiner and @CriquetShirts on Instagram®; (c) you must tag @thepreppytexan in the caption section of your posted photo; (d) the photo must be tagged with the #txyourprep hashtag; (e) the photo must be uploaded during the Entry Period; (f) the photo must be uploaded in accordance with Instagram®’s Terms of Use (http://instagram.com/about/legal/terms/#); and (g) any other terms or conditions of these Official Rules.
Each uploaded photo that satisfies these Official Rules constitutes one single entry into the Contest. You may enter as many times as you like, but you may only enter the same photo one time. Any entrant that provides materially false information will be disqualified. The maximum cost of entering depends upon any materials purchased to complete your Entry, any Internet usage fees and any other fees you may elect to incur in connection with your Entry.
PRIZE AND APPROXIMATE RETAIL VALUE OF THIS CONTEST:
One winner will receive the following Prize: (a) One Criquet Shirt brand shirt of his or her choosing (provided it is in stock and on the webpage criquetshirts.com); (b) One Criquet Shirt brand sweater of his or her choosing (provided it is in stock and on the webpage criquetshirts.com); (c) Two Arnold Steiner pocket squares (1 labeled Preppy Texan Special Edition and 1 of the winners choosing, provided it is in stock) (d) One Arnold Steiner neck tie (of the winners choosing, provided it is in stock) (e) One Arnold Steiner bow tie (of the winners choosing, provided it is in stock)
The approximate retail value of the Prize is $300. The instructions for collecting the Prize will be sent to the winner via direct message to the Instagram® account that uploaded the winning photo. The Prize is non-transferable. No substitution or transfer of Prize is permitted except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for one of equal or greater value if a component of the Prize should become unavailable for any reason.
If the Prize is not claimed or if for any other reason the Prize is not awarded after the first selection, subsequent Entries will be determined to be the winner until the Prize is awarded to a selected winner. Prizes may not be used in conjunction with any other promotion or offer and may not be separated and must be accepted as awarded.
Winner must claim prize by October 15, 2015 or prize will be forfeited. Shipping costs will be incurred by The Preppy Texan.
ELIGIBILITY FOR THIS CONTEST:
This Contest is run by The Preppy Texan (“Sponsor”). This Contest is open only to persons who are 18 years of age or older as of September 15, 2015, and who are legal residents of the United States. Void where prohibited by law. Employees of Sponsor, and its agents, affiliates, subsidiaries, employees, directors, sales representatives, distributors, retailers, partners, and each of their respective parent companies, advertising, fulfillment, promotion and interactive agencies, contractors and any others engaged in the development, production or distribution of promotion materials for this Contest, and their immediate families and persons residing in the same households of each of these individuals, whether related or not (collectively “Sponsor Parties”), are ineligible to enter or win. This Contest is subject to all United States federal, state, and local laws. Sponsor reserves the right to verify the eligibility qualifications of any potential winner.
CONDITIONS OF ENTRY FOR THIS CONTEST:
An eligible entrant must enter by uploading a photo to Instagram® as described in these Official Rules. Only one entry may be submitted per person. Entries will be deemed to be submitted by the natural person acting as the authorized account holder of the applicable Instagram® account. All entries submitted that are not in compliance with these Official Rules are void. Incomplete entries are void, including any inappropriate, incomplete or duplicative entries. Neither Sponsor, nor Sponsor Parties, assumes any responsibility for late, lost, illegible, or misdirected entries. By entering, entrants accept and agree to these Official Rules, including all eligibility requirements. Upon submission of your entry, you grant Sponsor Parties a worldwide, perpetual, non-terminable, irrevocable, transferable, license to access, use, distribute, perform, reproduce, display, modify, create derivative works based upon, and sublicense such information and content for the purpose of providing the Contest, prizes, and for all other business purposes of Sponsor.
By submitting any information or content to Sponsor Parties, including by uploading a photo and related information to Instagram® as described herein, you represent that you have the full legal right to provide such information and content and that use of the information by Sponsor Parties will not: (a) infringe any intellectual property rights of any person or entity or any rights of publicity, personality, or privacy of any person or entity; (b) violate any law, statute, ordinance, or regulation; or (c) constitute disclosure of any confidential information owned by any third-party.
You further represent that the photo will not, in Sponsor’s sole discretion: (a) be defamatory, libelous or trade libelous, unlawfully threatening, or unlawfully harassing; (b) impersonate any person or entity or falsely state or otherwise imply an affiliate with a person or entity or is generally false, deceptive, misleading, deceitful, misinformative, or constitute a “bait and switch”; (c) be obscene, child pornographic, or indecent; or (d) violate any community or Internet standard.
CONTEST WINNER SELECTION:
Judging will be based on the following criteria (“Judging Criteria”):
Uniqueness of Personal Style (50%);
Overall Creativity of the Photograph (25%);
Originality of Composition (25%);
The decisions of the judge are final and binding. In the event of a tie, the participant whose submission received the highest score for Creativity, as determined by the judge, in his sole discretion, will be deemed the winner.
On or before October 5, 2015, Sponsor will select winner.
Sponsor will notify the Winner as set forth above on or about October 5, 2015. Sponsor is not responsible for any changes to a winner’s account information with Instagram® or other information which may interfere with winner notification. Failure to comply with all instructions in the prize notification, or if a prize is not claimed prior to October 15, 2015, may result in disqualification of the entry and the selection of an alternate winner.

The information provided by Sponsor in connection with the Contest is for informational purposes only. Upon submission of your entry, or other material or information to Sponsor Parties in connection with this Contest, you grant Sponsor Parties a worldwide, perpetual, non-terminable, irrevocable, transferable, license to access, use, distribute, perform, reproduce, display, modify, create derivative works based upon, and sublicense such information and content for the purpose of providing the Contest, prizes, and for all other business purposes of Sponsor.
By entering this Contest, you hereby certify that you have complied with all the rules of this Contest and that you have committed no fraud or deception in entering this Contest or in claiming any prize. By entering this Contest you grant Sponsor Parties the right to print, publish, broadcast, and use universe-wide in any media now known or later developed at any time or times, your name, Instagram® account name, portrait, picture, voice, likeness, and biographical information for any purpose, including for advertising and promotional purposes without additional consideration, except where prohibited by law.
BY ENTERING THE CONTEST OR ACCEPTING ANY PRIZE, EACH ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES AND AGREES THAT SPONSOR PARTIES, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY, THE ENTRANT FOR ANY AND ALL LIABILITY FOR ANY INJURY, LOSS, OR DAMAGE OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF THE PRIZE OR PARTICIPATION IN THIS CONTEST OR ANY PRIZE RELATED ACTIVITY. You hereby agree to release and hold harmless INSTAGRAM® from any and all liability, claims or actions of any kind whatsoever for any injuries, damages or losses of any kind in connection with, either directly or indirectly, this CONTEST.
CHOICE OF LAW AND JURISDICTION:
All applicable federal, state, provincial and local laws and regulations apply. This Contest and all matters, issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants, winners, and Sponsor in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the State of Texas of the United States, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Texas or any other jurisdiction), which might otherwise cause the application of the laws of any jurisdiction other than the State of Texas. Any action seeking legal or equitable relief arising out of or relating to the Contest or these Official Rules shall be brought only in the state and federal courts of the State of Texas.

Sponsor Parties are not responsible or liable for any events beyond their control, which may cause this Contest to be stopped, including any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, nor are they responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error, filtering or traffic congestion on the internet or at any web site, insufficient space in an entrant’s account to receive messages or any combination thereof, including any injury or damage to entrant’s or any other person’s computer relating to or resulting from participation in this giveaway or downloading any materials in this Contest. If, for any reason, this Contest is not capable of being conducted as planned, including due to tampering, unauthorized intervention, typographical errors, technical failures, fraud, low participation, or any other causes beyond the reasonable control of Sponsor Parties that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor Parties reserve the right at their sole discretion to cancel, terminate, modify, or suspend this Contest.
